The Family Courts (Amendment) Bill 2022

On 26th July, 2022, the Lok Sabha passed the Family Courts (Amendment) Bill, 2022. It seeks to amend the Family Courts Act, 1984 to establish family courts in Himachal Pradesh with effect from February 15, 2019 and in Nagaland with effect from September 12, 2008.

Need

Absence of Legal Authority

  • Two family courts were established in Nagaland in 2008 and three in Himachal Pradesh in 2019, via notifications issued by the two State governments.
  • However, these courts were functioning without any legal authority since no central notification was issued as prescribed under Section 1(3) of the Family Courts Act.
