Suspension of MLAs

On 31st January, 2022, the Supreme Court set aside the one-year suspension of 12 BJP MLAs from the Maharashtra Legislative Assembly.

What Supreme Court Said?

  • The Supreme Court held that suspension for a year was ‘unconstitutional, substantively illegal and irrational’.
  • The bench had pointed out that as per the relevant rules, the Assembly has no power to suspend a member beyond 60 days.
