What safeguards, under the Constitution, are provided to civil servants, against any arbitrary dismissal from their post?

Answer: Recruitment, condition of services for person appointed to public services/civil services under Centre and State are regulated under Article 309.

However, Article 310 deals with the tenure of civil service office. Under that, civil servants under Centre or in All India Services hold the office during the pleasure of the President.

Article 311 provides some safeguards to the civil servants against the doctrine of pleasure. They are:

  • A civil servant cannot be dismissed by any authority who is subordinate to the authority who appointed him.
