What are the powers given to the judiciary by the Constitution in order to function as an independent and impartial institution?

Answer: The Supreme Court of India acts as a guardian of the Constitution and ensures fundamental rights of citizen. Therefore, it is necessary that certain powers must be assigned to judiciary in order to work as an effective and impartial institution.

The Constitution has given following powers to the Supreme Court to ensure its independence:

  • Judges of the Supreme Court appointed by the President only from consultation of judiciary itself.
  • Supreme Court judges are provided with security of tenure. They can be removed by the president only in manner and on grounds mentioned in the Constitution.
