Explain the concept of separation of powers with respect to Indian Constitution. Does the concept of separation of powers is more about principle of checks and balances?
Answer: Separation of powers is division of powers among three organs of government i.e. Executive, Legislature and Judiciary. The purpose of separation of powers is to prevent the abuse of power by a single organ. It will guard the society against arbitrary decision and ensure checks and balances among the different organs.
Although the concept of separation of powers is not explicitly mentioned in the Constitution, there are some provisions which reflect the concept:
(i) Article 50 mandates state to separate Executive from Judiciary.
(ii) Article 123, empowers president to legislate in certain conditions only.
