National Company Law Appellate Tribunal

On 26th June, 2023, Google approached the Supreme Court challenging the National Company Law Appellate Tribunal (NCLAT) order upholding Rs. 1,337 crore penalty imposed on the company by the Competition Commission of India (CCI).

NCLAT Order

  • NCLAT stated that the CCI in its order against Google did not violate the principles of “natural justice” and based it on relevant material submitted to it.
  • It held that Google asking the Original Equipment Manufacturers (OEMs) to pre-install the entire Google Suite of 11 applications amounts to imposition of unfair conditions.
