The impeachment of judges is an ineffective way to tackle the issue of compromised ethics in judiciary. Analyse it in the light of recent examples.

Answer: Article 124(4) and 217(1) of the constitution provide for the removal of judges of Supreme Court and High Courts respectively. The Judges Enquiry act (1968) regulates the procedure related to the removal of judges of the judges of Supreme Court. The Act sets out the following steps for removal from office:

  • An impeachment motion may originate in either House of Parliament when
    1. At least 100 members of Lok Sabha give a signed notice to the Speaker, or
    2. At least 50 members of Rajya Sabha give a signed notice to the Chairman.
