New Telecommunications Interception Rules, 2024
On 6th December 2024, the Union Government introduced the Telecommunications (Procedures and Safeguards for Lawful Interception of Messages) Rules, 2024.
- These rules replace Rule 419A of the Indian Telegraph Rules, 1951, empowering specific authorities to intercept messages under defined conditions.
Key Provisions
- Authorization for Interception: The Union Home Secretary or State-level Home Secretaries are now authorized to order interception, with provision for Joint Secretaries to act in unavoidable circumstances.
- Emergency Approvals: Heads of authorized agencies can approve interceptions in remote areas or during operational emergencies, with retrospective approval required within seven days.
