Writ Petitions
Writ petition means petition filed by a petitioner in which She/he requests the issuing of a writ to redress her/his grievances. There are five-types of writs issued include habeas corpus, mandamus, prohibition, certiorari and quo-warranto.
Constitutional Provisions: Article 32 of the Constitution (Right to Constitutional Remedies) available to Supreme Court, concurrent with the jurisdiction of the high court under Article 226.
- Judicial Pronouncements: In the Chandra Kumar case (1997), the Supreme Court ruled that the writ jurisdiction of both the high court and the Supreme Court constitute a part of the basic structure of the Constitution.
