Local Reservation in Private Sector

Constitutional Provisions: Article 16 guarantees equal treatment under law in matters of public employment & prohibit the state from discriminating on grounds of place of birth or residence.

Arguments in Favour of Local Reservation

  • Local reservation protects the right to life/livelihood of people domiciled in the state.
  • Shrinking employment presents a problem for states to provide employment, and owing to limited state’s capacity w.r.t. public employment, reservation of locals in private sector is necessary.
