Election Petition

Election Petition is a method for challenging the legitimacy of the results of parliamentary or local government elections.

Constitutional and Legal Provisions

  • The "High Court" shall be the authority for presenting election petitions under Article 329(b) of the Constitution, according to Section 80-A of the Representation of the People Act, 1951.
  • Section 123 of the Representation of People’s Act 1951 states what amounts to corrupt practice, including bribery, use of force or coercion, appeal to vote or refrain from voting on grounds of religion, race, community and language.
