Caste Census

Constitutional and Legal Provisions

  • Article 81(3) of the Constitution requires that upon the completion of each census, the representation of the several territorial constituencies in the House of the People and the Legislative Assemblies of each State.
  • The Census Act 1948 forms the legal basis for conduct of census in independent India.
  • In India, the population census is a Union subject (Article 246) and is listed at serial number 69 of the seventh schedule of the constitution.

Judicial Pronouncements: The Supreme Court in Maratha Reservation case, cited that the reservation must be backed by community specific data i.e., caste census.
