Article 12: Definition of State
- The Delhi High Court has ruled that the United Nations (UN) is not a State under Article 12 of the Constitution of India and is not amenable to its jurisdiction under Article 226 of the Constitution.
- As per CrPC (1908), to file a legal suit against foreign state, Ministry of External Affairs (MEA) approval/consent is required.
- An Indian diplomat filed a legal suit against UN post getting response from Ministry of External Affairs (MEA) that UN is an internal organization and no approval is needed to file legal suit.
