Education As Minimum Qualification to Contest Local Elections
- Recently, Rajasthan Government has scrapped education criteria for Panchayati Raj elections.
- Under Rajasthan Panchayati Raj (Second Amendment) Act, 2015 it was made mandatory for people contesting Zila Parishad, Panchayat Samiti and Municipal elections to have cleared Class 10.
- Previously Supreme Court had held that the Right to Contest is a Constitutional Right rather than a fundamental or statutory right and it can be regulated and curtailed through laws passed by the appropriate legislature.
- 73rd Amendment Act of 1992 provides for mandatory constitution of Panchayati Raj Institution as third tier of government at village level.
