Suo Motu Powers of the National Green Tribunal

On 7th October, 2021, the Supreme Court of India ruled that the National Green Tribunal (NGT) is vested with suo motu powers in discharge of its functions under the NGT Act.

Background

  • In September, 2021, the Centre held that the NGT does not have the power to take cognisance of a matter on its own.
  • The tribunal cannot be tied up in procedural law for exercising power which is amply available to it under the Act. Once the tribunal receives any communication, it is duty bound to take cognisance of that.
