Answer : The disbursement of benefits is one of the most challenging aspects of the functions of any civil servant. In this regard, the following stakeholders are involved in the case of Rakesh, the health worker.
Rakesh now is faced with a dilemma. On one hand, he as a normal kind and compassionate person could feel the need to help the old man who is ill. However, he is constrained by the fact that he is the guardian of a public scheme and in that capacity he is bound by the parameters of the scheme and can disburse funds only to intended beneficiaries.

Following the public outcry, the State government ordered the closure of the factory.

Question : Dr X is a leading medical practitioner in a city. He has set up a charitable trust through which he plans to establish a super-speciality hospital in the city to cater to the medical needs of all sections of the society. Incidentally, that part of the State had been neglected over the years. The proposed hospital would be a boon for the region.
You are heading the tax investigation agency of that region. During an inspection of the doctor’s clinic, your officers have found out some major irregularities. A few of them are substantial which had resulted in considerable withholding of tax that should be paid by him now. The doctor is cooperative. He undertakes to pay the tax immediately.
However, there are certain other deficiencies in his tax compliance which are purely technical in nature. If these technical defaults are pursued by the agency, considerable time and energy of the doctor will be diverted to issues which are not so serious, urgent or even helpful to the tax collection process. Further, in all probability, it will hamper the prospects of the hospital coming up.

In such a situation, there are both merits and demerits of both the above provided options. If you were to ensure compliance and ignore the minor technical defaults it would result in the recovery of tax money, construction of the hospital and overall benefit to the people of a very backward region at little inconvenience to the exchequer. However, it could also be seen as a slippage of tax collection discipline and could serve a stepping stone for such cases in the future.
However, if you were to pursue the case strictly, both on substantial and technical fronts, it would reaffirm the discipline of the taxation department as well as your reputation as a rule following administrator. It would however affect the construction of the hospital and could also lead to harassment of the doctor in question.
There has to be a multi pinged approach to the problem in question and it has to involve both suggestive and preventive steps. As the tax has been withheld, it has to be paid immediately and without delay along with applicable fines. Further, the minor compliance issues too are not something which can be overlooked in their entirety. However, as their utility both to the taxpayer and the government is limited, it should not become a source of harassment and/or trouble to either party. To this end, you should instruct a team to provide minimum time possible per week to cooperate with the taxpayer to sort of technical issues over a period of time as they are not urgent issues. Also, in order to ensure that such technical issues do not occur in the future for this or any other taxpayer, you could institute necessary corrections from your end and also institute a technical vigilance committee to gather further information.
If followed, these steps could lead to a peaceful tax settlement which benefits not only the taxpayers, but also the district administration and the people who would benefit from the construction of the hospital in the backward area, which in other words is a win-win situation and the best a public servant could hope for.
Question : Edward Snowden, a computer expert and former CIA system administrator, released confidential Government documents to the press about the existence of Government surveillance programmes.
According to many legal experts and the US Government, his action violated the Espionage Act of 1917, which identified the leak of State secret as an act of treason. Yet, despite the fact that he broke the law, Snowden argued that he had a moral obligation to act. He gave a justification for his “whistle blowing” by stating that he had a duty “to inform the public as to that which is done in their name and that which is done against them.” According to Snowden, the Government’s violation of privacy had to be exposed regardless of legality since more substantive issues of social action and public morality were involved here. Many agreed with Snowden. Few argued that he broke the law and compromised national security, for which he should be held accountable.

Answer : The case is about that, I am going for a very important interview of my life and found injured relative of mine on the way who require immediate help. But before taking any action, I will focus on some aspect in this case:

In the meantime, I will call taxi or auto or ambulance, whichever arrives first and take them to the hospital.

Answer : The value of life cannot be calculated. Furthermore, fault of a single day drinking should not cost loss of compensation of whole life. It was no fault of family. Also, the family have lost the breadwinner of the family, so, why punish the family by denying compensation?
Another important aspect is that company and workers both are complementary to each other and company should be sensitive to their worker. Being HR of the company, I have obligations & duty to both the company & the workers. My recommendations in this situation are:
1.According to Empolyees Compensation Act, 1938, a man who is drunk is not eligible for compensation. But on humanitarian grounds, I will recommend giving full compensation and give an offer for the family of deceased. However, as a PIO you have observed that there are citizens who filed RTI applications not for themselves but on behalf of such stakeholders who purportedly want to have access to information to further their own interests. Answer : Before giving suggestion, one aspect I must clarify that, RTI Act, 2005 was enacted to provide all the information to the public. Public is the actual owner of all the information in democracy. They should possess the knowledge except which can harm the owner. Such exceptions are already mentioned elaborately in Section 8 of RTI Act.
Further clarification is that among the exceptions, no such non-genuine applications are included. It is perfectly legal to ask information about others except the information should not be of personal-private in nature or of the nature of trade secret. Information belongs to the real owner - the public and it should be provided and should be kept in open domain. Keeping in mind the above arguments I will recommend:
Being a PIO, I have a public duty and it is not to conceal any wrongdoing. Thus, I will suggest disclosing every information even if they are filed by non-genuine RTI applicant provided that information is not exempted under Section 8 of RTI Act 2005.
Question : A fresh engineering graduate gets a job in a prestigious chemical industry. She likes the work. The salary is also good. Gandhiji advocated that means are as important as the end. In this context unethical means cannot be adopted for the development. Sustainable development can only be achieved by adopting the sustainable methods like grass root level development, peoples participation, environment conservation etc.
iv.This view point argues that if society is incapable of effectively preventing unethical conduct, for whatever reason, we might as well stop regarding that conduct as wrong. It encourages moral cowardice and ethics complacency.
Civil servants have special obligations because they are responsible for managing resources entrusted to them by the community, because they provide and deliver services to the community and because they take important decisions that affect all aspects of a community’s life. In this unethical behavior on the part of civil servants is not advisable/accepted.
Question : You are a no-nonsense, honest officer. You have been transferred to a remote district to head a department that is notorious for its inefficiency and callousness. You find that the main cause of the poor state of affairs is the indiscipline of a section of employees. They do not work themselves and also disrupt the working of others. You first warned the troublemakers to mend their ways or else face disciplinary action. When the warning had little effect, you issued a show cause notice to the ringleaders. As a retaliatory measure, these troublemakers instigated a woman employee amongst them to file a complaint of sexual harassment against you with the Women’s Commission. Household-based work means children working under the supervision of their parents/relatives. To evade child labour norms, several units project themselves as household-based works but employ children from outside.
