Breach of Parliamentary Privilege

Recently, a breach of privilege notice was filed against the Prime Minister for the government’s note to the Supreme Court of India claiming that the audit report on Rafale deal had been shared with the Parliament, when this had not been done.

  • Members of Parliament (MPs) enjoy certain parliamentary privileges which are bestowed on them collectively and individually so that they can discharge their duties and functions effectively.
  • In the case that any of these immunities or rights is disregarded by any MP, the act is regarded as a ‘breach of privilege’ and is a punishable offence under Laws of Parliament.
