Judicial Power of President to Grant Clemency
Recently, the Union Ministry of Home Affairs (MHA) has approved the commutation of death sentence to life term of Babbar Khalsa terrorist Balwant Singh Rajoana for his role in Punjab CM Beant Singh’s assassination on August 31,1995.
Clemency Powers
- Under Article 72 of the Constitution, the President has the power to grant pardons, reprieves, respites or remissions of punishment or to suspend, remit or commute the sentence of any person convicted of any offence:
(i)In all cases where the punishment or sentence is by a court martial;
(ii)In all cases where the punishment or sentence is for an offence ....
