Recently, Supreme Court has raised some questions and made suggestions regarding disqualification powers of the Speaker.
Disqualification Powers of the Speaker
- The speaker’s decision in all parliamentary matters (such as deciding whether a bill is money bill or not, disqualification matters under Tenth Schedule etc.) is final, binding and ordinarily cannot be challenged in the Court of law. Thereby, Speaker acts as the ultimate arbitrator.
- Supreme court has asked Parliament to amend the Constitution to strip Legislative Assembly Speakers of their exclusive power to decide on the matter of disqualification under the anti-defection law.
