Aadhaar Constitutionally Valid
- A Constitution Bench of the Supreme Court upheld the validity of Aadhaar but with certain caveats.
- Section 7 which demands Aadhaar based authentication to receive a subsidy, benefit or service etc. became the basis of Supreme Court upholding the validity of the Aadhaar Act being passed as a Money Bill.
- The court has upheld the validity of Section 59 that also validates allAadhaar enrolment done prior to theenactment of the Aadhaar Act, 2016. Thecourt reasoned that since enrolment wasvoluntary in nature, those who specifically refuse to give consent would be allowed to exit the Aadhaar scheme.
