SC Stays New Tribunal Rules

The Supreme Court in February 2018 ordered that the selection and term of tribunal members will be as per the old rules.

Background: In June 2017, the Ministry of Finance had notified new rules affecting the selection process and functioning of all tribunals.

Earlier, members of a tribunal were appointed by a committee comprising the CJI’s nominee, two secretaries and chairman of the tribunal concerned.

What does it Mean?

The judgment effectively stayed the applicability of provisions of the Central Tribunal, Appellate Tribunal and other Authorities (Qualification, experience and other conditions of service of members) Rules, 2017.
