- H-1B visa holders, upon termination, have options to maintain authorized stay in the US.
- Options include filing for a change of non-immigrant status or an adjustment of status application.
- Workers may also apply for compelling circumstances leading to a one-year Employment Authorization Document (EAD).
- Another option is to become the beneficiary of a nonfrivolous petition to change employer.
- Failure to take action within the grace period may require leaving the country.
- USCIS had earlier announced changes to the H-1B visa registration process for 2025 to enhance integrity.
- These changes aim to improve integrity and streamline application processes, effective from FY 2025 registration period.
