Right to Abort

Right to abort is a right of a woman to decide on terminating her pregnancy.

  • Constitutional Provisions: Article 21 of the Constitution gives an unmarried woman the right of choice as to whether or not to bear a child on a similar footing as that of a married woman.

Statutory Provisions

  • Medical Termination of Pregnancy Act, 2021: Terminating a pregnancy up to 20 weeks will only require the medical advice of one doctor whereas abortion is legal for women in certain circumstances up to 24 weeks like survivors of rape, victims of incest and other vulnerable women (like differently-abled women, minors) ....
