Election Symbols

Constitutional Provisions: The Election Commission of India derives its mandate to allocate election symbols under Article 324 of the Constitution.

  • Legal Provisions: The Election Symbols (Reservation and Allotment) Order, 1968 and its amendment in 2017 empower the Election Commission to recognise political parties and allot symbols.
  • Judicial Pronouncements: The Supreme Court (SC) in Sadiq Ali and another vs. ECI, 1971 upheld the validity of the Election Commission as the only authority to decide issues on a dispute or a merger of political parties and allotting election or party symbol to them.
