Digital Rights imply the right to privacy and data protection. It also addresses issues of equal distribution of Internet access regardless of economic background.
- Constitutional Provisions: Article 21 of the constitution deals with right to privacy aspect of digital internet whereas article 19 deals with the freedom of speech aspect of digital rights.
- Judicial Pronouncements: In Faheema Shirin v. State of Kerala, the Kerala High Court declared the right to Internet access as a fundamental right forming a part of the right to privacy and the right to education under Article 21 of the Constitution.
