Issues with Election Commission of India

Election commission is a constitutional three member body which is vested with the powers to superintend, direct and conduct elections in a free and fair manner under Article 324.

1. Constitutional Challenges
  • The President of India appoints the Chief Election Commission (CEC) and the Election Commissions , and no law has been made yet by the parliament for this thereby vesting the power of appointment of such an important body with the executive.
  • The constitution has not prescribed any qualifications (legal, educational, administrative, or judicial) for the members of the Election Commission.
  • The Constitution has not specified the term of the members ....
