Supreme Court Upholds FCRA Amendments Impacting NGO Funding
On 8th April, 2022, in a significant verdict, the Supreme Court of India upheld the amendments made to the Foreign Contribution (Regulation) Act, 2010.
- The Foreign Contribution (Regulation) Amendment Bill, 2020 was passed in both houses of Parliament in September 2020.
- It seeks to regulate the process involving acceptance and utilisation of foreign contributions by individuals, associations and companies.
About the Petition
A group of non-profit organisations had challenged the following provisions before the apex court:
- The ban on transferring foreign contribution by an FCRA-registered organisation to any other person.
- The requirement of submission of Aadhaar for all senior functionaries.
