Ninth Schedule of the Constitution
Recently, the Jharkhand Assembly passed a Bill to raise the total reservation for Scheduled Castes (SC), Scheduled Tribes (ST) and Other Backward Classes (OBC) in State government posts to up to 77%. However, it would come into force only after the Centre carries out amendments to include these in the Ninth Schedule of the Constitution.
Need to Include in Ninth Schedule
- The 77 % reservation breaches the 50 % ceiling set by the Supreme Court in the 1992 Indra Sawhney vs. Union of India verdict.
- Placing a legislation in the Ninth Schedule shields it from judicial scrutiny.
