Reservation for OBCs in Local Bodies Only Statutory, Can’t Breach 50% Ceiling: Supreme Court
The Supreme Court recently said that reservation in favour of Other Backward Classes in concerned local bodies cannot exceed an aggregate of 50 per cent of the total seats reserved for Scheduled Castes, the Scheduled Tribes and OBCs taken together.
- The judgment came on petitions challenging Section 12(2)(c) of the Maharashtra Zilla Parishads and Panchayat Samitis Act, 1961, which provided that the State should provide 27 per cent reservation to OBCs.
- The plea also questioned the Maharashtra State Election Commission (SEC) notification in 2018 and 2020 providing for reservation exceeding 50 per cent in respect of Zilla Parishads and Panchayat Samitis ....
