On 17th September 2024, the Competition Commission of India (CCI) announced that it can now appoint independent agencies to monitor the implementation of its orders, following the notification of amended regulations.
- This regulatory change allows the CCI to enhance oversight on compliance with its directives, addressing concerns raised by entities regarding non-compliance.
- The newly introduced Competition Commission of India (General) Regulations, 2024, were officially notified on September 17, 2024.
- Agencies that may be appointed include accounting firms, management consultancies, and professional organizations such as chartered accountants and company secretaries.
- The CCI will utilize these agencies to oversee the implementation of orders issued under various sections, including those related to mergers and acquisitions.
- The appointed agencies will be responsible for informing the CCI of any non-implementation or failure to comply with its orders.
- In addition to the monitoring provisions, the new regulations stipulate a 180-day timeframe for passing a final order following the issuance of an interim order.
- This amendment comes in response to changes made to the Competition Act in April 2023, during which the CCI conducted a thorough review of its general regulations, including public consultations.
